The test is simple: is your packaging first placed on the Belgian market, delivered directly to a Belgian end consumer, by a company without a Belgian entity? If so, you are the producer — and the law requires you to appoint a Belgian authorised representative. There is no minimum volume: the obligation applies from the very first package.

Your legal status: under Article 2, 20° of the Belgian Interregional Packaging Agreement (as amended, in force since 3 Sep 2020), a foreign company selling directly to Belgian consumers is a Type B packaging producer and must appoint an AR established in Belgium — using the word « désigne » ("must appoint"), not "may appoint".

The risks of non-compliance are concrete: Amazon suppresses your Belgian offers at ASIN level (your product stays listed but Belgian buyers can't purchase), plus administrative fines from €727.25 per infringement and, in serious cases, criminal penalties up to €2,000,000.
