Ask a seller what "EU compliance" means and you will usually hear VAT. EPR is the obligation they discover later — usually when a marketplace suspends a listing. They are different regimes. Here is how to tell them apart, and why you need both.
TL;DR — VAT is a tax; EPR is an environmental obligation. Both are mandatory when you sell into the EU, both are organised country by country, and both can suspend your listings — but they run on different rules and different registers.
VAT: a tax on the sale
Value-added tax is a consumption tax on your sale. Non-EU sellers use the IOSS (for imports under €150) or OSS (for intra-EU sales) to register and remit VAT in one place. It is a finance obligation, handled by an accountant or a VAT agent, and it is about money.
EPR: responsibility for the waste
Extended producer responsibility is an environmental obligation about the packaging and product you place on the market — registering as a producer, joining a producer responsibility organisation, paying eco-fees and reporting volumes. It is not a tax, and the VAT agent who handles your filings does not handle this.
Where they look similar, and where they diverge
- Both are country by country — you register in each member state where you sell.
- VAT has a one-stop shop (IOSS/OSS); EPR does not — each country needs its own registration and, for non-EU sellers, its own authorised representative.
- Both can suspend listings — marketplaces verify VAT numbers and EPR numbers, but through different checks.
- Different professionals — an accountant does VAT; a compliance provider with local reach does EPR.
Why the confusion is costly
The most common trap is assuming that "I'm VAT registered, so I'm EU compliant." VAT registration does not register you for EPR, does not appoint your authorised representative, and does not protect you from packaging or WEEE enforcement. A seller can be fully VAT compliant and still have every EU listing suspended for a missing EPR number.
The practical takeaway: treat VAT and EPR as two separate compliance tracks, both mandatory, both country by country. Finishing one does not finish the other.
